"A federal appeals court [Tuesday] upheld U.S. EPA's retroactive veto of a water permit for a West Virginia mining project in a big win for the Obama administration.
The U.S. Court of Appeals for the District of Columbia Circuit affirmed a lower court's decision that EPA had "adequately explained" its decision to revoke the Clean Water Act permit for the mountaintop coal mining project.
Arch Coal Inc. and its subsidiary, Mingo Logan Coal Co., have long sought to overturn the agency's 2011 veto of the water permit for the controversial Spruce No. 1 mine in Logan County, W.Va."
