San Diego Loses Suit Over Pollution Cleanup Beneath Stadium

"A federal judge has ruled strongly in favor of a major energy firm that [San Diego] sued for roughly $250 million over its pollution cleanup efforts beneath 166-acre Qualcomm Stadium site."



"The city filed the lawsuit in 2007 against Houston-based Kinder Morgan Energy Partners, which owns a tank farm holding about 26 million gallons of gasoline, jet fuel and diesel fuel near the stadium, alleging the company hasn’t moved quickly enough on its cleanup job.

U.S. District Court Judge Michael Anello issued a Jan. 25 ruling that sided with Kinder Morgan on all counts. He rejected the city’s expert testimony as “unreliable and irrelevant” and that the statute of limitations had expired for some of the allegations. He also noted the city lacked a viable water project for the site that could have led to damages. The summary judgment means the case won’t go to trial. "
